Introduction
These Terms and Conditions govern your membership of Blackbeard’s wine club (“Club”). By becoming a member of our Club, you agree to be bound by these Terms and Conditions, as well as any other policies or rules we may establish from time to time, including website terms of use and privacy policy found on our website (blackbeardswineclub.ky).
Membership
- Eligibility: To become a member of our Club, you must be 18 years of age or older.
- Registration: To join our Club, you will be required to complete a registration form, which will include your personal information, such as your name, address, and credit card information.
- Subscription: By registering for our Club, you agree to pay the subscription fee, which will be charged to your credit card monthly.
- Termination: You may cancel your Club membership at any time by emailing us at [email protected].
- Wine club does not include any in-store price promotions. Polyn points cannot be collected for wine club nor is a further discount applied.
- There are inherent risks in consuming alcohol and alcohol should be consumed in moderation. Red wine in particular may cause staining if spilt so extra care should be taken. Certain wines can be volatile due to the buildup of gasses. Extra care should be taken when opening bottles of wine. The correct storage of wine is of vital importance.
We reserve the right to deny any membership for any reason , at our sole discretion. We reserve the right to terminate your membership if you breach these Terms and Conditions or for any other reason, at our sole discretion. If subscription is pre-paid Blackbeard’s Wine Club will reimburse the member the outstanding amount.
Wine Selections
- Monthly Selections: As a Club member, you will receive a monthly delivery of six bottles of wine selected by our experts. In the event of incorrect or damaged bottles we will exchange the wines.In the event that any of the bottles of wine are incorrect, missing or damaged, please let us know within 24 hours. Where the incorrect, missing or damaged bottle of wine is part of a case, we reserve the right to either replace the bottle of wine, provide an alternative bottle of wine of equivalent value or credit your account with the amount representing the value of the incorrect, missing or damaged order contents.
- Tiers: You may customise your monthly tiers by contacting us before the 20th of each month.
- Delivery: We will deliver your monthly wine selection to the address you provide us. No additional delivery fees are added. You must be available to receive your wine shipment and sign for it upon delivery. If someone else is signing and/or collecting your wines they must be 18 years of age or older.
- Pick up: If you choose to pick-up your wine from our Camana Bay or Eastern Avenue locations proof of identity will be required in the form of the bank card to make the payment and photo ID.
- Wines purchased from us are for the customer’s own use only (which may include their use as gifts for third parties). Wines may not be re-sold or otherwise used for commercial purposes.
- Storage of Wines: It is the responsibility of the member to store the wines correctly, no liability will be on Blackbeard’s Trading Company Limited and/or Blackbeard’s Wine Club for any wines damaged due to handling, storage and/or other act or omission of the member.
- Disclaimer of Warranty: Blackbeard’s Wine Club warranties that the products shall be delivered to the member in an undamaged condition. Except where expressly provided by these terms and conditions Blackbeard’s Trading Company Limited gives no warranties, conditions, guarantees or representations as to the quality of fitness for a particular purpose of the products and all other warranties, conditions, guarantees or representations, whether express or implied are hereby excluded to the extent permitted by law.
Payment
- Subscription Fee: Your subscription fee will be charged to your credit card monthly.
- Suspension of Membership: If your subscription fee payment is not received on time, we reserve the right to suspend your Club membership until payment is received.
- Cancellation: You may cancel your Club membership at any time by notifying us in writing at [email protected] . Refunds will not be issued for any subscription fees paid.
Legal Compliance
- Age Verification: By becoming a Club member, you represent and warrant that you are 18 years of age or older. We reserve the right to request proof of age and to refuse service to anyone who cannot provide satisfactory proof of age this also includes signing off and collection of delivery of wines.
Liability
We will not be liable to any third party for any loss, damage or costs which arise as a result of:
- Your failure to lift, transport, store or otherwise handle any product in an appropriate and safe manner;
- Any spillages or breakages involving one or more of our products.
In no event shall Blackbeard’s Trading Company Limited and/or Blackbeard’s Wine Club be liable to member or to any third party for any consequential, incidental, indirect, exemplary, special whether arising out of breach of contract, tort (including negligence), or otherwise, regardless of whether such damage was foreseeable.
In no event shall Blackbeard’s Trading Company Limited and/or Blackbeard’s Wine Club aggregate liability arising out of or related to this terms and conditions, whether arising out of or related to breach of contract, tort (including negligence), or otherwise, exceed one month’s membership fees.
Indemnification: You agree to indemnify, defend, and hold us harmless from any and all claims, damages, or expenses arising from your membership in the Club or your use of the wine we provide.
Changes to Terms and Conditions
We reserve the right to change these Terms and Conditions at any time, in our sole discretion. We will notify you of any changes by email or by posting a notice on our website. Your continued membership in our Club following the posting of any changes will constitute your acceptance of such changes.
Data Privacy
Blackbeard’s takes privacy very seriously and will only use applicants’ personal data for the purposes of this promotion. Applicants understand that Blackbeard’s will be collecting their personal data in connection with this promotion and hereby consent to the collection, use and processing of such personal data for the purposes of same. Such personal data may also be shared with third parties and/or affiliates of Blackbeard’s in connection with this promotion.
